Have you suffered from whiplash?

If you have suffered from whiplash due to an accident which was not your fault, you may be entitled to make a whiplash compensation claim. Most personal injury solicitors are able to take whiplash claims on a no win no fee basis. This means that if your whiplash claim is unsuccessful, you will not have to pay your solicitors fees. Many personal injury solicitors will also be able to guarantee you keep 100% of your whiplash compensation.

Whiplash claims are some of the most common personal injury compensation claims made in the UK. This is largely due to the number of road traffic accidents that occur in the UK each year. However, whiplash claims are not solely made following car accidents. Whiplash claims can also be made following other types of accidents, such as slips and trips, where the neck is suddenly thrown backwards and forwards.

Whiplash injuries can vary from minor neck pain for a couple of weeks to severe whiplash which can last for several months or years. In some extreme cases whiplash can even cause permanent injuries. Depending on the severity of your whiplash, your GP may recommend painkillers, light exercises or even a course of physiotherapy.

If you have been involved in a road traffic accident, or any other accident which was not your fault, and have suffered from whiplash as a consequence, you may be entitled to make a whiplash compensation claim. Contact a personal injury solicitor who will be happy to discuss your whiplash claim and help you through the process of making a no win no fee personal injury claim for whiplash.

What is Whiplash?

Whiplash is the term given to describe the sudden movement of the neck in a forwards and backwards motion. This causes the soft tissue in the neck to be stretched and strained. Whiplash is most commonly caused by car accidents, but whiplash can also be caused by other accidents, including slips and trips.

What are the symptoms of whiplash?

The most common symptom of a whiplash injury is pain and stiffness in the neck. However, whiplash can also cause a number of other symptoms, including back and shoulder pain, headaches, loss of movement in the neck, blurred vission and pins and needles.

Symptoms of whiplash may not be experienced immediately after an accident. This is becuase following an accident adrenalin can often take over, supressing the pain and affect of whiplash for several hours. In fact, it is not uncommon for symptoms of a whiplash injury to go undetected for several days.

The severity of a whiplash injury can vary significantly from person to person. While some people make a full recovery within a few days or weeks, other people can suffer with a whiplash injury for several months or even years.

How is a whiplash injury caused?

Whiplash is most commonly caused when a car crashes into the rear of a stationery or slow moving vehicle. However, whiplash can also be caused by other road accidents, as well as slips and trips.

Although your head is restrained during a car crash by your seatbelt, your head is not. Therefore following impact your head is thrown backwards and forwards, causing the whiplash injury. Generally speaking, the greater the impact, the more severe the subsequent whiplash injury will be. However, even a slow moving minor car accident can result in a whiplash injury.

If you have been involved in an accident which was not your fault and has resulted in a whiplash injury, you may be able to make a personal injury compensation claim.

As with all personal injury compensation claims, you would need to prove that another person was responsible for your whiplash injury.

To help your case, you should take names, addresses and telephone numbers of any witnesses to the accident and take photographs of the accident locus if possible. If the whiplash injury is caused in a Road Traffic Accident and the negligent driver has no valid insurance, leaves the scene or admits to driving a stolen vehicle, you should contact the Police immediately and report the incident.

If you are intending to claim expenses such as prescription costs and travelling expenses incurred as a result of your whiplash injury, remember to keep receipts as evidence.

The amount of compensation you receive for whiplash injuries varies from case to case depending on the severity of the whiplash injury. The more time you spend recovering from your whiplash injury the more money you will be entitled too.

The amount of compensation you maybe entitled to for claimants who only suffer a minor strain and only suffer for a few weeks the amount could be as little as £750 up to £2,550..

A slightly more moderate type of whiplash injury where the injury has exacerbated or accelerated some pre-existing unrealted condition, the amount of damages could be in the region of £4,575 to £8,150.

Very severe cases where the injured are severely disabled with permanent spastic quadriparesis these claims may have a value of up to £86,500 allthough these cases are rare. The person would have very little or no movement in their neck and suffer from severe headaches.

As well as carrying out excercises, in some cases of whiplash it may also be necessary to take some form of pain relief. Normally paracetamol would be sufficient, but in some cases your doctor may prescribe some stronger painkillers.

It is important that you try to exercise and continue your normal routine as soon as possible, as research has shown that whiplash patients who rest for several weeks and wear a soft collar actually take longer to recover.

Below are some excercises to help relieve the pain of a whiplash injury from netdoctor.co.uk.

Stand against a door or a wall with your head facing forward and move your eyes so you look towards the two, four, eight, and 10 o’clock positions. Repeat this a few times. This eye movement causes a slight movement in some deep muscles in the back of the head.

Next, take a step forward and perform the following movements.

Bend the back of the head carefully forward as if taking a bow. Return to the starting position with your head straight and facing forward.

Draw the chin in towards your neck and bend the head carefully forward. Return to the starting position. Bend the head backwards far enough to look at the ceiling. Return to the starting position.

Tilt the head sideways, so the right ear is near the right shoulder. If possible try to maintain the glance at a fixed point at eye level. Return to the starting position. Repeat this action with the head tilted to the other side.

Turn the head as if trying to look backwards over the shoulder, first to the left and then to the right. Imagine following a horizontal line on the wall at eye level.

You can also use a beach ball or a soft ball to exercise the head and neck muscles. Place the ball between the wall and the forehead and then try to move it around on the wall in circles or figures of eights. Repeat the exercise, this time placing the ball between the back of the head and the wall.
